Trademark Application Status - Explained
TRADEMARK.APPLICATION.STATUS | DESCRIPTION OF STATUS |
Send To Vienna Codification | In case the application contains any figures, elements or pictures, the trademark Registry sent the application for Vienna Codification |
Formalities Chk Pass | The application meets all basic requirements and is ready for processing. |
Formalities Chk Fail | The registry has raised some technical queries as to basic requirements and the same has to be addressed to process the application. The applicant has to address the query and file an application for rectification of errors identified by the Registry to process the application further. |
Marked for Exam | Application has been marked for Examination by Registry. |
Awaiting Reply to Examination Report | Application is objected by the Registry with reason stated in the Examination Report. The applicant has to file a Reply to Examination Report within 30 days of the report. If no reply is filed within the stipulated timelines, the application will be ABANDONED by the Registry. |
Objected | The examination Report filed by the applicant is under review by the Registry. |
Ready for Showcase Hearing | The status “Ready for Showcause Hearing” means the reply to the objection has been processed by the registry and the application is marked for Showcause Hearing. If the hearing is not attended on the scheduled date, the application will be ABANDONED by the Registry. |
Accepted | Application is accepted by the registry for advertisement. |
Accepted & Advertised | Application is accepted by the registry and an advertisement has been published in the Trademark Journal. Anyone can oppose the trademark application within 4 months of advertisement. If there is no opposition within the timelines, the registry will issue a Certificate of Registration. |
Opposed | Application is opposed by a third party. The applicant has to follow Trademark Opposition Process to defend the opposition and get the application processed further. If the Opposition process is not addressed, the application will be ABANDONED by the Registry. |
Registered | Trademark Registration Certificate issued by the Registry. |
Abandoned | Application is abandoned by Registry. |
